2010年7月3-4日，由复旦大学社会科学高等研究院（以下称“高研院”）主办，中国政治学会（美国）、复旦大学国际关系与公共事务学院、复旦大学人文与社会科学季刊（Fudan Journal of the Humanities and Social Sciences）和《中国社会科学辑刊》杂志社协办的第二届“政治学与中国政治发展年会”之“合法性与治理”国际学术研讨会在复宣酒店四楼报告厅举行。
参加本次学术研讨会的有来自中央编译局、清华大学、中国人民大学、北京师范大学、北京大学、厦门大学、武汉大学、华东师范大学、南开大学、吉林大学、中山大学、深圳大学、上海师范大学、上海交通大学、浙江大学、台湾大学、香港大学、香港特别行政区政府中央政策组、European University、University of Wisconsin-Madison、University of Denver、German Institute of Global and Area Studies、Fayetteville State University、University of Utah、University of Regina、National University of Singapore、Swinburne University、University of Leiden、University of Nottingham、Boston University、University of Notre Dame、Tuebingen University、University of Houston、University of Western Ontario、Central Compilation and Translation Bureau、Old Dominion University、University of Tennessee、University of Macau、Middlebury College、University of Lodz、Copenhagen University、Bucknell University、Montclair State University、College of Europe和复旦大学等多家学术机构的六十余位知名学者。复旦高研院研究人员郭苏建、林曦、刘清平、顾肃、孙国东、纳日碧力戈、吴冠军、陈润华、沈映涵、邓正来等参加了本次学术研讨会。
开幕式由复旦大学特聘教授、高研院院长邓正来教授主持，他代表高研院向到场的各位嘉宾表示了热烈的欢迎。
中国著名政治学家、中央编译局副局长俞可平教授在开幕式上做了大会基调发言，他感谢了复旦高研院的盛情邀请，围绕“善治与合法性”这一主题，提出“善治是21世纪政治合法性主要来源”的命题。他强调：
第一，在当今时代，政治合法性正在发生重大的转型，合法性的主要来源正在从福利、民主、善政转向善治，后者将会是“人类在21世纪最重要的政治合法性来源”。究其原因，俞可平教授分析到：二十世纪以来，人类所面临的“合法性危机”比哈贝马斯提出“合法性危机‘的那个时代所面临的更加严重，而不断地产生合法性危机和不断地解决合法性危机正是人类政治生活的常态。合法性危机是人类政治发展的动力，其产生和解决是人类政治进步的表现。近代以来，福利、善政和仁政逐渐成为了合法性的主要来源，特别是民主和法治几乎直接意味着政治合法性。21世纪以来，人类在合法性问题上又遇到了新的挑战：一方面，发达国家在输出自由民主的运动中陷入了极大的困境，无论在前苏联还是东欧地区，抑或是亚非拉等地，成功的案例很少，失败的案例很多。尤其在伊拉克和阿富汗，这种西式民主对于利益双方都是灾难性的结果。另一方面，非西方式的民主在一些国家的成功，正在动摇传统的民主理论，特别是中国和新加坡等亚洲国家，在经济上的成功和在政治上的稳定，正在使越来越多的西方学者怀疑并反思政治合法性的主要来源究竟是什么，代议民主是不是合法性的主要来源等问题。
第二，俞可平教授认为善治主要包含以下八个要素：法治、参与、公正、透明、责任、有效、稳定、严谨。从政治学角度上讲，治理是公共权威为了实现公共利益而进行管理活动的过程，而治理中的善治则是公共利益最大化的管理过程，是政府与公民社会共同合作的公共管理。
第三，俞可平教授重点剖析了善治作为21世纪政治合法性主要来源的五点原因：善治包含传统的政治理想状态，如善政（good government）、仁政等，但又超越了传统政治；善治包含了现代民主政治的大多数基本要素，但又超越了民主的范畴；善治是服务于民生的必要条件，也是民生提高的必然结果；善治意味着经济的发展、社会福利的提高，更意味着社会正义、公民政治参与和政府透明等方面的改善；善治具有超时空性，不同于许多其他政治概念充满了争议和分歧。
最后，俞可平教授指出，通向作为理想政治状态的善治是一个长期的过程，在人类社会发展的目前状态下，善政依然有不可取代的地位，也是走向善治的关键，因此民主和法治也依然是达到善治的决定性因素。
同时，来自台湾大学的朱云汉教授也做了题为“民主合法性的类型学分析”的基调发言。他主要讲了如下几个要点：
首先，朱云汉教授区分了传统政治哲学和现代政治科学对民主合法性的不同进路，传统政治哲学重规范性研究，将民主合法性视为民主政府在道德上的证成，而政治科学的进路则是将民主合法性视为一个经验性的事实来加以研究，重视社会心理、因果关系等方面的探讨。在这一经验性研究的进路当中，首当其冲的是民意（或称之为公众舆论public opinion）的研究，通过问卷、访谈和调查等形式搜集当下的公众舆论和观点，以此作为衡量政府是否达致“善治”（good governance）的一个标准。在此基础上，出现了一个全球性的“舆论调查网络”的指标（barometer），对不同国家的民主程度进行测评。当然，朱云汉承认，要对民主合法性进行测量是一件很困难的事，有相当多的理论和比较研究都试图去回答这个问题。
对于许多调查而言，一个经常向公众提出的标准问题是，“比起其他形式的政府，您是否更偏好于民主？”对于这个问题，一个值得我们关注的现象就是在民主运动高涨的地区，如韩国，人们的偏好于民主的程度，反而远远比不上政治形势更稳定的地区，比如日本。这实际上促使研究者去弥补目前广泛存在的民主调查方式中的缺陷。一个方法就是扩大民主合法性的内涵，增加“公众态度”这一维度，另一个方法就是将上述这种单项的测量标准与其他因素结合起来，这些因素可以测量，公众是在何种程度上与其他的威权主义政府形式（authoritarian alternatives）保持距离。当然，这两套弥补方案都远非尽善尽美，实际上，研究者要得出的结论，即“公众偏好民主”与“公众反对其他的威权主义政府形式”，此两者之间并没有绝对的联系。为了避免这种“非此即彼”、貌似公允但实际上强迫受访者“站立场”和“表姿态”的调查方法，朱云汉提到了一种替代的调查方法，那就是在调查的过程当中，避免使用“民主”这样的字眼（the ‘D’ Word），而是转而关注民主的极大核心价值，诸如政治平等、公众问责制、政治自由主义、政治多元主义以及分权制衡。
这样的一个调查方法，就可以使研究者能够很好地将公众的“民主取向”（democratic orientation）分为以下几个类型学上的维度：批评性、一致性、非民主和表面性的民主拥护者。在这样一个调查方法当中，研究者将使用到相当多的定量和定性的社会科学研究方法，比如回归分析、换算系数、缺省值计算等等。总而言之，朱云汉的基调发言为我们“衡量”民主合法性提供了一种严谨的“政治科学”进路。
本次会议共有七场专题讨论，分别是：合法性：中西比较；合法性：不同研究路径；合法性与治理的关系；合法性在中国的理论与实践；政权合法性与大众支持；中国的治理理论与实践；中国在全球治理中的作用等。每场专题讨论均分为主题发言和问答讨论两个环节。
专题讨论结束后，复旦大学特聘教授、高研院院长邓正来教授做了总结发言，他指出：
其一，从背景上看，全球化时代的到来给合法性问题带来了巨大的挑战。在全球化时代前，现代性的合法性的确立主要是以威斯特伐利亚体系这一个结构安排为基本背景的，涉及当时欧洲的文化、政治、经济、宗教的基本形势，以民族国家的主权为严格依凭，现代性合法性问题基本上是在一国内完成。而随着全球化的加剧，产生了许多任何单一政权无法靠自己力量解决的问题，例如全球整体安全问题、绿色革命问题以及公民社会问题。
其二，站在国别以及学术研究者的角度来看，我们发现合法性问题的世界主义时刻已然到来。前面的叙述告诉我们，现时代要求不同性质的政权共同体来应对和解决这些全球问题，也即对解决全球问题的诉求已经进入到了合法性之内。更明确地说，在全球化时代，世界正在转型，交流日益密切，合法性问题因此成为跨国问题。一方面，一国政权必须认真面对“如何在国内有序治理”和“如何应对全球性问题的挑战”这两个问题；另一方面，社会科学学者必须进行相应的调整，也即必须回答下述问题：“全球性问题如何进入到我们对合法性问题讨论的内在纬度”；“既然法治、民主等概念严格以主权国家为边界，那么我们怎么能找到更好的概念工具和理论范式来进行研究”等等。
其三，针对中国的合法性问题，我们不得不追问经济持续发展与政权稳定之间的关系，我们也知道中国已经不再是一个孤立的中国，而是在世界结构下的中国，对外开放使得合法性问题必须得到他国的评价。因为合法性问题在中国转型期呈现出复合性和共时性这两个特性，所以我们在研究中将会面对“如何更贴近中国实际的进行合法性问题研究”、“地方多元的合法性与中央政权的合法性是什么关系”、“中国共产党在合法性问题中的重要作用是什么”诸如此类的问题，进而坚持历史和当下的本土视角，破除停留在概念层面上的研究，找到与当下中国人的生命更为紧密的关联。
最后，邓正来教授再次代表会议主办方向诸位嘉宾和到场旁听的学者和学生们表示了衷心的感谢，并宣布本次学术研讨会圆满结束。
据悉，本次学术研讨会上诸位学者的论文近期将结集出版。
